Contest Description
Terms and Conditions: Maxis

Maxis Bid to Win contest (”Contest”) will start on 9th May 2007 09:00 and will end on 16th May 2007 00:00 (”Contest Period”). Entries received after the stipulated time will not be entertained and/or allowed to participate in the Contest.

To Qualify
1. This Contest is open to all postpaid & prepaid customers of Malaysian Mobile Services Sdn Bhd (”Maxis”) who are:

a: residents of Malaysia; and

b: above the age of 18 years

For participants below the age of 18 years, parental consent must first be obtained.

2. Maxis employees, agencies, subsidiaries, affiliates, related corporations, dealers, retailers and all their immediate family members are not eligible to participate in this Contest.

3. Participants must ensure that their Contest entries (including all details and personal information provided) are complete and accurate. Incomplete, illegible, non-complying or late entries shall be disqualified.

To Bid
1. Participants shall participate in the Contest using their mobile phones only.

2. To enter the Contest, Participant will send an SMS message ‘bidon’ to 22001. By sending the SMS message, Participant is deemed to have accepted the Terms and Conditions of the Contest.

3. Participants have to answer a question correctly via SMS before being allowed to bid for the prize.

Charges
1. Each SMS received by Participant after the SMS submissions of answers and bids to 22001will be charged a premium charge of 35 cents per SMS.

2. These charges are in addition to the standard SMS fee charged by Maxis for sending an SMS to 22001.

Winner Selection
1. Participant with the lowest bid and unique bid number will win the bid.

2. Winners will be contacted by Maxis via their mobile phone number used to participate in the Contest within fourteen (14) business days from the last day of the month.

3. Participants are encouraged to keep their mobile phones activated during this period. If the winner cannot be contacted after attempting to do so for three (3) consecutive days, that winner will automatically be disqualified and the Participant who is the next winner in line will be selected.

4. The winner announced by Maxis shall be final and conclusive and no correspondence, complaint or appeal shall be entertained by Maxis at any time during or after the Contest Period.

5. Maxis shall have the sole and absolute right to consider any entry or bid as null and void if the participant or winner fail to meet any of the fulfilment criteria.

Collection of Prizes
1. Maxis will, at a later date, advise winners in respect of the location for collection of prizes.

2. Prizes and bid items depicted in the website and advertisements are strictly for advertising purposes only and they may or may not resemble the actual prizes.

General
1. Maxis reserves the absolute right, without any prior notice, to substitute or replace any of the prizes with another of similar value at any time, if the stated prizes are not available due to unforeseen circumstances. All prizes are non-transferable nor redeemable for cash.

2. Maxis is not responsible for the merchantability of the bid item or the prizes.

3. Winners are responsible for all taxes, fees or charges payable in respect of any prizes awarded to them.

4. By accepting this Terms and Conditions, Maxis has the right to utilise the winner’s detail and personal information provided including but not limited name and photograph for promotional or advertising purposes or any other use as it deems fit and without prior notice or consent required from the winner and without further compensation and notice, unless prohibited by law.

5. Winners undertake that they are the legal and registered owners of the mobile phone numbers used in participating in this Contest.

6. By participating in the Contest, Participant agrees to be bound by the Terms and Conditions.

7. The Contest shall in all respects be governed by the laws of Malaysia. However, it shall be the sole responsibility and obligation of the Participant and winner to ensure that he/she complies with and does not contravene any laws to which he/she may be personally subject to.

8. Maxis reserves the right to, at any time without prior notice to vary, add to or amend any of the Terms and Conditions of this Contest (including the prizes and/or discontinuing the Contest at any time) and Maxis shall not be liable for any loss or inconvenience resulting therefrom.

9. Maxis shall not be liable to the Participant or any other party for any loss or damage of whatsoever nature suffered by Participant or subscriber as a result of participation or non-participation in the Contest or as a result of any act or omission on the part of Maxis.

10. In addition to these Terms & Conditions, the rules, regulations and methods of participation in the Contest, which are set out on www.maxis.com.my and www.hotlink.com.my shall bind all participants in the Contest. Failure to comply with the Terms & Conditions, rules, regulations, instructions and methods will result in the participant being disqualified.

11. Maxis cannot accept responsibility for any error, omission, interruption, deletion, delay in operation or transmission, communications line failure, whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

12. Maxis reserves the right to reject any Participant at its absolute discretion without having to assign any reasons whatsoever.
